Desperate times call for desperate measures.

We may never be able to give credit to the originator of this old saying but according to the Oxford dictionary of quotations, on the 6th November 1605, Guy Fawkes is reputed to have said  ”The desperate disease requires a dangerous remedy”.  I mentioned last week that there would be some self defense discussion this week so here goes.

I’ve received several reports the last couple of weeks concerning field inspectors and preservation contractors that are not getting paid, or are getting only small portions of their accounts receivable.  And, as is usually the case, I got pinched too.

I received a check for $5.00 on a $2000.00 receivable.  No typos there – thats five dollars and two thousand dollars  I made one phone call that has not been returned – just one.  I used to get very upset when my phone calls were not returned.  Especially when money was involved.  But now, I hardly let it take more than five minutes out of my day.  Just enough time to fax the info to our attorneys.

If you’re in this business or thinking about getting in the business, you need to understand that there are some really ugly players in this ball game.  And, with the current business climate it appears more companies have taken up playing with funny money.  Yea, I know that is rather blunt, but notice that I said “more companies”, not “some companies”.  That means there has always been some shenanigans going on somewhere in this business.

Stay on your toes and don’t let your accounts receivable grow too large.  I’ve talked with a few contractors that are really sweating.  One to the tune of $20,000 and another $50,000.  Also, take into consideration that “desperate measures” for some may include not sending you your money.

How do you acquire the self defense I mentioned?  You need legal representation!  If you don’t have access to a good legal advisor, you may want to check out a good pre-paid legal plan.

    Terry,
    I have seen you on many groups. I am just wondering if there is anyplace where accused contractors who truly did not do anything wrong have a voice. Is it just in the courts, just in the state environment. I know for a fact, because it happened to me, that an angry person with a history of law suits can attempt to ruin your life by making and filing claims that are not true. Yes, attorneys and other issues will clear it up but it seems all onesided. It seems that the inspector who claims someone flatly refused to pay them is the only voice heard, and the facts can be whatever that person says. Also, it seems that although, anyone can make filings and anyone can get bad results, nobody seems to know that until the court date, until its before a judge, the accusations do nothing but potentially hurt someone. After years of this business, all of these sites have something bad to say about virtually every company out there once you add them up. It seems everyone is in a business that they all either hate or have little to no respect for those that did go far, their own way. It is okay to work the the money you WANT to work for if it works for you and its also ok to work for a company you like without other people insulting you because of it. I love all of your postings, here and other places, just wondering where the other side of the story is!
